1. Acceptance of Terms
By accessing the website qovlixe.com or engaging the services of Qovlixe, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use this website or engage our services.
These Terms of Service govern the relationship between Qovlixe (referred to as "we", "us", or "Qovlixe") and any person or entity using our website or services (referred to as "you" or "client").
2. Description of Services
Qovlixe provides independent acoustic measurement and consulting services for residential apartment buyers in Chile. Our services include:
- Pre-handover acoustic inspection: on-site measurement of sound insulation between apartment units.
- Co-investment group verification: coordinated multi-unit acoustic inspections.
- Post-occupancy acoustic assessment: measurement and documentation of acoustic performance in occupied units.
- Technical consultation: review of construction documentation and preliminary acoustic assessment.
The specific scope of services for each engagement is agreed in writing before the commencement of work.
3. Scope and Nature of Services
Our acoustic measurements are performed using calibrated equipment following standardised methodology (ISO 16283). Results are compared against the requirements of NCh 352 and presented in a written report.
Our reports present technical measurement data and compare it against regulatory standards. They are informational documents. They do not constitute legal advice, engineering certification, or a guarantee of any particular outcome in any legal, administrative, or commercial process.
We do not make representations about the future acoustic performance of any building, nor about the outcome of any negotiation or legal process in which our reports may be used.
4. Limitations of Service
Acoustic measurements are performed at a specific point in time under specific conditions. Results may vary if measurements are repeated under different conditions (different time of day, different ambient noise levels, different furniture configuration, etc.).
Our services cover the measurement points agreed in the service scope. We do not measure every possible transmission path or every room in a building unless specifically agreed.
We do not provide legal advice. If you intend to use our report in legal or administrative proceedings, we recommend you consult a qualified legal professional.
5. Client Obligations
To enable us to perform our services, you agree to:
- Provide accurate information about the building, units, and access arrangements.
- Coordinate or assist in obtaining access to the relevant units and adjacent units for measurement purposes.
- Ensure that the units to be measured are accessible and in a condition suitable for measurement on the agreed date.
- Notify us promptly of any changes to access arrangements or building conditions.
6. Payment
Service fees are agreed in writing before the commencement of work. Payment terms are specified in the service agreement. We reserve the right to withhold delivery of the final report until payment has been received in full.
Cancellations made less than 48 hours before a scheduled on-site visit may be subject to a cancellation fee as specified in the service agreement.
7. Intellectual Property
The inspection report prepared for you is provided for your personal use in connection with your property purchase or ownership. You may share the report with your legal advisors, real estate agents, or the building developer in connection with the specific property transaction.
You may not reproduce, publish, or distribute the report for commercial purposes without our prior written consent.
All content on the website qovlixe.com, including text, design, and graphics, is the intellectual property of Qovlixe and may not be reproduced without permission.
8. Limitation of Liability
Qovlixe's liability in connection with any service engagement is limited to the fee paid for that specific engagement. We are not liable for any indirect, consequential, or incidental losses arising from the use of our reports or services.
We are not responsible for decisions made by you based on the information in our reports. The decision to proceed with, withdraw from, or negotiate a property transaction rests entirely with you.
9. Governing Law
These Terms of Service are governed by the laws of the Republic of Chile. Any disputes arising from these terms or from the provision of our services shall be subject to the exclusive jurisdiction of the courts of Santiago, Chile.
10. Changes to These Terms
We reserve the right to update these Terms of Service at any time. Updated terms will be posted on this page with a revised "Last Updated" date. Continued use of our website or services after the posting of updated terms constitutes acceptance of those terms.
